Sorting out ownership of an SMSF at the end of a relationship is complex. There’s the legal aspects ie. preparing the paperwork and court orders to make that all legal, and then implementing the ownership change or winding up.

This Platform won’t be able to deal with your SMSF, so you’ll need some extra expert help with that. See our ‘Partner’ page for a list of trusted colleagues who can help with this aspect.

Do you or your partner own more than one item of real estate?*

Owning more than one property can create added complexity to preparing your legal agreement, especially if there is debt associated with the properties.

Our Platform deals only with one item of real estate. If ownership of that property and its debt is simple, you might choose to proceed in using our Platform, bearing in mind you’ll likely need extra legal help to prepare the legal wording for what’s to happen with the other property/properties and their associated debt.

Because these sort of interests can be complex, we encourage you to speak with a lawyer for some advice first before using our Platform.

Will spouse maintenance be paid as part of your agreement?

Our Platform doesn’t facilitate the inclusion of spouse maintenance orders.

That being said, you could use our Platform to generate your draft Proposed Consent Orders, and have a lawyer prepare and include your agreed spouse maintenance orders.
