Overview

For an agreement to be binding, it must clearly define ‘who’, ‘what’, ‘when’, and ‘how’, and potentially include ‘what-if’ scenarios. Couples who miss these details or who don’t provide enough detail have their Consent Orders Application rejected (requisitioned).

The Proposed Consent Orders addresses this for you in legalese.

The Proposed Consent Orders (draft) is suitable for anyone with a simple financial separation agreement—no SMSFs, no real estate transfers/sale, no companies, no complex business interests or family trusts.

Important

The Proposed Consent Orders is one of two documents required for a Financial Consent Orders Application. The Application for Consent Orders is the second document, which is a free download from the FCFCOA’s website.

The Application involves some maths and calculation, and can be complicated to complete by yourself.

Consider having a lawyer review your Proposed Consent Orders (draft) and Application once prepared, before signing and submitting to the Court.
